These terms set out the agreement between your business and us for using tuix. You accept them, and the data processing agreement that is part of them, by ticking the box that says so when you sign up or buy a paid plan. They are also the rules for our services provided by electronic means (regulamin) under the Polish Act on providing services by electronic means. They are available free of charge at tuix.app/terms before you sign up, and you can save and print them at any time.

1. Who we are

tuix is provided by Maciej Wciślik Trąbka Świata, ul. Stryjeńskich 15a lok. 60, 02-791 Warszawa, Poland, registered in CEIDG (the Polish Central Register and Information on Economic Activity), REGON 140261166, VAT/NIP PL9590959380 ("tuix", "we", "us"). You can reach us by email at support@tuix.app, on business days, 9:00–17:00 Polish time.

2. What these terms cover

tuix gives your business access, over the internet, to software for reporting bugs and collecting feedback on websites and web apps: the people using your site or app report a problem or an idea on the page where they see it, with a screenshot and technical details, and your team handles the reports and talks to the reporters until the problem is fixed. These terms cover two services we provide by electronic means (together, "the service"):

  • Access to the software: the widget you add to your web app, the dashboard, the APIs, the hosted MCP server for AI apps, email notifications, the Slack integration, and the packages and plugins we provide to install the widget, within the limits of your plan (section 7).
  • Keeping your workspace: holding your account, its projects, people and data, and letting you sign in to them. We keep providing this service while a workspace is lapsed (section 9), when most features are off, until the agreement ends (section 19).

Our Shopify app is coming soon. It will be sold and billed through Shopify under its own terms. These terms do not cover it.

The agreement is made of these terms, the data processing agreement at tuix.app/dpa (the "DPA"), and the plan you choose. If these terms and the DPA conflict on personal data, the DPA wins. Our privacy policy (tuix.app/privacy) and our subprocessor list (tuix.app/subprocessors) explain how we handle personal data.

3. Words we use

  • Agreement: the agreement between your business and us for the service, made of the documents in section 2. Section 5 says when it is concluded.
  • You: the business that signs up and accepts these terms.
  • Workspace: your account on tuix, with its projects, people and data.
  • Owner: a person with the workspace role "Owner". Owners manage the workspace and its plan.
  • Team member: a person who counts toward your plan: an owner, a project admin, or someone your team invited.
  • App people: the people your app identifies to the widget so they can report problems. They are free and unlimited, and do not count as team members unless your team invites them or makes them an admin. Their access is subject to your plan; on Free (developer), they can use the widget locally but cannot join the dashboard.
  • Customer data: everything you, your team and your app people put into tuix: reports, comments, screenshots, console and network entries, browser details, the identities your app sends, and your settings.

4. Business customers only

tuix is for businesses. Consumers may not sign up or use it. By accepting these terms you confirm that you act for a business, in connection with its trade, business or profession; that the person accepting may bind that business; and that the company details you give us, including your tax number, are true and kept up to date.

We check EU VAT numbers in the EU's VIES system. We may refuse or end an account that we reasonably believe is not a business.

Sole traders. If you are a natural person running a business registered in Poland's CEIDG, and the agreement is not of a professional nature for you (Polish law judges this mainly by the business activities you have registered), Polish law gives you some of a consumer's protections. Nothing in these terms takes them away. In particular:

  • a term that would be an unfair contract term for a consumer does not bind you (art. 385⁵ of the Polish Civil Code);
  • the rules on the conformity of digital services with the contract apply to you (art. 7aa and chapter 5b of the Polish Consumer Rights Act), and the exclusions and limits in sections 16 and 17 apply to you only as far as those rules allow;
  • you may withdraw from the agreement, or from the purchase of a paid plan, within 14 days without giving a reason (art. 38a of the Polish Consumer Rights Act). The period starts on the day you accept these terms or, for a paid plan, on the day you buy it. Tell us before the period ends by email to support@tuix.app or by post to our address (section 1). A short statement is enough, for example: "I withdraw from my agreement with Maciej Wciślik Trąbka Świata for the tuix service (workspace: name; accepted or bought on: date). Name and address of the business. Date." We refund what you paid within 14 days of your statement, by the same payment method. If you asked us to start the service before the period ended, we keep the proportional fee for the service provided until your statement;
  • disputes may also go to the court that would be competent under the general rules (section 21).

5. Your workspace and your people

Signing up. You sign up with your work email and choose whether to start a trial or use Free (developer). We generate initial workspace and display names, which you can change later in Account settings. Before you can send the signup form, you must tick the box confirming that you have read and accept these terms and the DPA on behalf of your business; sending the form without it accepts nothing. We then email you a link, which works for 15 minutes.

When the agreement is concluded. The agreement is concluded when you use that link: it creates the workspace, starts your trial or Free (developer), and makes you its first owner. If you do not use the link in time, no agreement is concluded. Buying a paid plan later (section 8) is concluded when its payment succeeds, after an owner has again ticked the box accepting these terms and the DPA, and it becomes part of the same agreement. Everyone signs in with emailed links, not passwords, so anyone who controls a team member's inbox can sign in as them. Keep those inboxes secure.

Your team. You decide who can see and manage each project. You are responsible for who you invite, for what your team does in tuix, and for removing people who should no longer have access.

Signing. Each project has a server-only signing key. Your app uses it to sign the identity, and the email address, of each person it sends to the widget. Keep the key out of browser code, repositories and tickets, and tell us at support@tuix.app if it leaks. tuix treats a signed email address as proven, and, where your plan allows it, can let that person into your project's dashboard, so sign only addresses your app has verified. Keep signed identity required for every project used by people outside your organisation: turning it off lets anyone who knows the public project key pretend to be any of your app people.

Unauthorised access. Tell us at once at support@tuix.app if you think someone has unauthorised access to your workspace.

6. Free trial

If you choose a trial at signup, the new workspace gets a free 14-day trial of the paid plan you pick (Team, unless you pick another), without a payment card. Choosing Free (developer) instead creates a workspace without a trial (section 7). Each email address can start one trial. When the trial ends, the workspace lapses unless you choose a paid plan (section 9). A trial never turns into a paid plan by itself, and we never charge you unless an owner chooses a paid plan and pays. We may extend a trial, for example while paid plans cannot yet be bought.

7. Plans

The paid plans are Solo, Team and Agency. They differ in the number of team members and active projects, how long screenshots and logs can be kept, and whether Slack updates are included. Current limits and prices are on tuix.app/pricing and on your billing page. Team and Agency can add extra members for a fee.

Free (developer). This is a free, hosted plan for one developer working on their own machine: 1 team member, 3 active projects, up to 14 days of screenshots and console and network logs, and AI access. It accepts reports only from local origins, such as localhost and loopback addresses, in the local environment. It does not support hosted staging or production sites, public tunnels, Slack updates, extra team members or people from your app joining the dashboard. People identified by your app can still report through the widget locally. The plan runs on tuix.app; it is not self-hosted, and reports are sent to and stored by tuix.

Free (developer) needs no payment card, has no subscription fee or scheduled expiry, and does not turn into a paid plan automatically. Each email address can create one Free (developer) workspace. Choosing it does not use that address's free trial; the address can later create a separate trial workspace. An owner can upgrade the developer workspace to Solo, Team or Agency by paying through Billing, without a trial on that upgrade. The paid plan starts when payment succeeds. Moving from a paid plan to Free (developer) is not available through self-service Billing. The other terms, including business eligibility, acceptable use, suspension and ending the agreement, still apply.

Upgrades between paid plans take effect at once. A new period starts that day, and we credit the unused part of the current one.

Downgrades between paid plans take effect at the end of the period. You must first remove team members and archive projects above the smaller plan's limits. If the smaller plan keeps screenshots and logs for less time, each project's retention is lowered to the new maximum, and older screenshots and logs are deleted within about an hour. The billing page names the affected projects before you confirm.

Complimentary plans. Separately from Free (developer), we may give some workspaces, such as partners, a complimentary plan, and may end that arrangement with 30 days' notice.

8. Fees, taxes and invoices

This section applies to paid plans and paid extras. No fees are due for Free (developer).

Prices. You pay for your plan and any extra members in advance, monthly or yearly. A year costs ten months. Prices exclude VAT. We charge in PLN if your billing country is Poland; in EUR elsewhere in the European Economic Area, in Switzerland and in the United Kingdom; and in USD elsewhere. The currency is fixed at your first payment.

Payment. Payments go through our payment provider, Mollie B.V., Amsterdam, the Netherlands. Mollie handles your card and bank details; we never see or store full card numbers. Yearly plans can also be paid by BLIK, Przelewy24 or bank transfer, in which case we email the owners a payment link 14 days before renewal.

Automatic renewal. A paid plan renews for another month or year, at the price in force under this section, until an owner cancels it (section 19). When an owner pays by card or SEPA Direct Debit, they authorise us to charge that card or account for each renewal, and for extra members they add, until the plan is cancelled. Checkout shows the plan, the renewal period and the amount before you pay. Cancelling stops all later charges.

Delivery. tuix is provided online; nothing is shipped. A trial or Free (developer) workspace starts when you first use the signup link we email you, according to the option you chose. A paid plan or an upgrade takes effect when its payment succeeds; if you pay during a trial, the paid period starts when the trial ends. Downgrades take effect at the end of the period (section 7). The billing page and an email confirm each payment.

Price changes. The price at your first payment applies to later renewals. We may change it by emailing the owners at least 30 days before the renewal at which it applies. If you do not accept it, you can cancel before then. Discounts we agree apply until the agreed end, or until we end them with 30 days' notice.

VAT. Checkout shows the price, the VAT and the total before you pay. Buyers in Poland pay Polish VAT. For a business in another EU country whose VAT number is confirmed in VIES, the reverse charge applies. Otherwise we charge the VAT the law requires. You must give us correct tax details.

Invoices. For every payment we issue a VAT invoice through our invoicing provider, Fakturownia, send it to KSeF (the Polish National e-Invoicing System) as Polish law requires, and email it to your invoice address. Invoices are in Polish for buyers in Poland, and in Polish and English for others.

Failed payments. If a renewal fails, we email the owners and try again after 3 and 7 days. The workspace keeps working for 14 days after the paid period ends, then lapses (section 9). A chargeback ends the paid period on the day it happens.

Refunds. We do not refund fees when you cancel or downgrade; your plan runs to the end of the paid period. We refund the unused part of a prepaid period only where sections 4, 13, 18, 19 or 20 or the DPA say so, or where the law requires it. We pay refunds by the payment method you used, within 14 days of the event that gives rise to them.

9. Lapse and suspension

Lapse. A workspace lapses when its trial ends without a paid plan, or 14 days after a paid period ends unpaid. While lapsed, the widget is off in every project and you cannot invite people or create or unarchive projects. The dashboard, AI read access and all your data keep working. Nothing is deleted. Paying again turns everything back on, with a new period from the day you pay.

Free (developer) does not lapse for lack of payment or because a trial ends. Suspension and ending the agreement still apply.

Long lapse. If a workspace stays lapsed for 90 days, we may end the agreement. We will email the owners at least 30 days before it ends, so you can pay again or ask for a copy of your data. If we end it, the workspace and its data are then deleted as section 19 says ("After the end"); until the agreement ends, nothing is deleted because of the lapse.

Suspension. We may suspend a workspace if you or your team seriously break these terms, to stop a security threat to tuix, other customers or people in your app, or if the law or an authority requires it. While suspended, nobody can sign in, the widget is off, and API and AI access stop. Nothing is deleted. We tell the owners before we suspend where we reasonably can, otherwise promptly after, with the reason, and we suspend only as much and as long as needed.

10. Acceptable use

You must not use tuix, or let others use it, to:

  • store or send content that is unlawful, infringes anyone's rights, or is malicious;
  • capture data you have no right to capture, including by installing the widget in a site or app you do not control or are not authorised to change;
  • capture special categories of personal data (such as health data), payment card numbers or passwords without a clear legal basis and need. Use masking (data-tuix-mask), the capture settings and the network allow and deny lists to keep such data out;
  • collect data from people without telling them (section 12);
  • test or break the security of tuix, look for other customers' data, or get around sign-in, access controls, plan limits or rate limits;
  • put an unreasonable load on the service, or run load or penetration tests without our written permission;
  • copy, modify, decompile or reverse engineer the service, the widget, the packages or the plugins, except where the law allows it;
  • resell tuix or offer it to others as a standalone service.

Where your plan allows it, you may use tuix for your clients: install it in apps you build or run for them and invite their people into your projects. Free (developer) remains limited to local development and does not include client access to the dashboard. You are responsible for them under these terms.

Security problems. If you find a vulnerability, tell us at security@tuix.app and give us reasonable time to fix it before telling anyone else.

Illegal content. tuix stores content at the request of its users, so it is a hosting service under the EU Digital Services Act (Regulation (EU) 2022/2065, "DSA").

  • Point of contact. Our single point of contact for authorities of the EU member states, the European Commission and the European Board for Digital Services (art. 11 DSA), and for users of tuix (art. 12 DSA), is support@tuix.app. You can write to us in English or Polish. Messages are read and answered by people, not only automated tools.
  • Reporting illegal content. Anyone can tell us about content in tuix they believe is illegal by writing to support@tuix.app. Please give: why you believe it is illegal; where exactly it is, such as the address of the report or screenshot; your name and email address (not needed if you report child sexual abuse material); and a statement that you believe in good faith that the report is accurate and complete. We confirm receipt, decide promptly, carefully and objectively, and tell you our decision and how you can challenge it.
  • What we may do. If content is illegal or breaks these terms, we may remove it or disable access to it, suspend the workspace (section 9) or end the agreement (section 19). People at tuix make these decisions; we do not use automated tools to find or moderate content. We act with care and proportion, with regard to the rights and legitimate interests of everyone involved, including freedom of expression.
  • Telling you why. If we restrict your content or your workspace, we tell the owners by email, at the latest when the restriction starts, unless the law forbids it or an authority asks us not to. We say what we restricted, the facts and the reasons, whether we acted on a notice, the legal ground or the term of these terms concerned, and how you can challenge the decision: by replying to us, and before the courts (section 21).
  • Crimes. If we learn of anything that suggests a criminal offence threatening someone's life or safety, we tell the competent authorities at once (art. 18 DSA).

11. Customer data

It is yours. You allow us to host, copy, process and send customer data only as needed to provide the service, to keep it secure, and as the DPA allows. For personal data in customer data, you are the controller and we are your processor (or your subprocessor where you act for a client). The DPA covers how we handle it.

What we do not do. We do not sell customer data or use it to train AI models. We do not look at reports, screenshots or logs except to provide the service, to help you when you ask, to keep the service secure, or when the law requires.

Retention. Screenshots and console and network logs are deleted automatically after each project's retention period, which a project admin sets up to your plan's maximum. Other customer data stays while your workspace exists, unless you delete it. A project admin can delete a person from your app, with everything they wrote, in Project settings.

Your integrations. Services you connect, such as a Slack channel or an AI app through our MCP server, are your integrations, not our subprocessors. Data you send to them is governed by your agreement with their providers. We cannot delete messages already delivered to Slack. A connected AI app acts as the person who connected it; you are responsible for what it does.

Usage data. We collect technical data about how the service runs, such as widget load times, error categories and how well pins find their elements, and use it to run and improve tuix. Ideas you send us about tuix are covered in section 14.

12. Your responsibilities for personal data

You are responsible for having a legal basis for what tuix captures in your app; for telling your app people that you use tuix, what it sends and who can see it (the DPA has suggested wording); for any notice or consent your law requires for the preferences the widget keeps in their browser storage; for setting capture, masking and retention to fit your app; and for answering people's requests about their data with the tools the DPA describes.

Reports and screenshots made by one of your app people can be seen by other identified people in the same project and environment. Console and network logs are visible only to the report's author and project admins.

13. Our service

Changes. We may change, add or remove features. If a change removes or materially reduces something your paid plan includes, we will tell the owners at least 30 days ahead. If you do not accept it, you can end the agreement before it takes effect and get a refund of the unused part of your prepaid period.

Availability. We work to keep tuix available, but we offer no service level agreement or service credits. The service may be interrupted for maintenance, updates or reasons outside our control. We try to do planned maintenance at quiet times and to tell you about major incidents.

Support. We answer email to support@tuix.app on business days, 9:00–17:00 Polish time, without a guaranteed response time. Features marked as preview or beta may change or end at any time and are provided as they are.

Technical requirements. You need an internet connection, an email account and a current version of Chrome, Edge, Firefox or Safari (16.4 or later), with JavaScript and cookies turned on. Your app must be able to load the widget, which may need changes to its Content Security Policy; Project settings show them.

What we place on devices. tuix.app sets one strictly necessary cookie that keeps you signed in and protects forms, and the dashboard keeps your theme and list filters in your browser's storage. The widget keeps the reporter's preferences and the time they were last active in the browser storage of your app's site. Our privacy policy explains this.

Risks of using online services. Any service used over the internet carries risks, such as malware, phishing (fake emails or pages that imitate ours to steal sign-in links), interception of data on insecure networks, and someone using an inbox or device that is not theirs. To reduce them: keep your devices and browsers up to date, use sign-in links only from emails you expect and only on tuix.app, keep your team's inboxes secure, and keep signing keys on your server (section 5). We never ask for your sign-in link or keys by email or phone.

14. Intellectual property

We own tuix: the service, the widget, the packages, the plugins and their documentation, including the copyright in the software.

Licence. While the agreement lasts, we grant you a non-exclusive, non-transferable licence, which you may not sublicense, to use the software for your business, including commercially, within the limits of your plan and these terms. Under it you may use the service through the dashboard, the APIs and the MCP server; install, run and display the widget, packages and plugins in web apps you run or build for your clients, and copy them as far as that needs; and let your team and app people use them through your workspace. The licence covers the countries where you and your clients use tuix and ends when the agreement ends.

What stays ours. Except as these terms expressly say, we grant you no intellectual property rights, patents or other property rights in the service or the tuix software. All rights, titles and interests in intellectual property that these terms do not expressly grant stay with us. Open-source components keep their own licences.

Your ideas. If you or your team send us suggestions, ideas or comments for improving the service, we may use them free of charge, without limits in time or territory, to develop tuix, with no duty to you. This does not give us any rights in your customer data.

We will not name you as a customer in public without your permission.

15. Confidentiality

Each of us will keep the other's confidential information confidential and use it only for this agreement. That includes customer data, signing keys and non-public details of our service, but not information that is public through no fault of the receiver, already known to it, developed independently or lawfully received from someone else. Either of us may disclose it where the law or a court requires, telling the other first where allowed. These duties last for 3 years after the agreement ends, and for customer data and trade secrets as long as they stay confidential.

16. Promises and disclaimers

We promise to provide the service with reasonable skill and care, substantially as our documentation describes, and to keep the security measures in the DPA. You promise that you are a business, that you may lawfully put customer data into tuix, and that you will use tuix lawfully.

Otherwise, we provide the service as it is. We do not promise that it will be uninterrupted or error-free, that every screenshot will be complete, or that every pin will find its element after your app changes. tuix is not a backup or a system of record. As far as the law allows, the statutory warranty for defects (rękojmia) and all warranties not stated here are excluded. This does not affect the rights of sole traders under section 4.

17. Liability

Cap. Each party's total liability under this agreement, including the DPA, is limited to the fees you paid us in the 12 months before the event that caused it, or EUR 100 if that is more.

Excluded losses. Neither party is liable for lost profits, revenue or business, or for indirect or consequential loss. For lost data, our liability is limited to restoring it from our backups where we can.

Not limited. Nothing here limits liability for damage caused intentionally or by gross negligence, or liability that the law does not allow to be limited. The cap does not apply to your fees or to section 18. These limits apply only between you and us; they do not affect people's rights under the GDPR, or the rights of sole traders under section 4.

18. Third-party claims

From you. You will cover our losses and reasonable costs from third-party claims, including by people in your app or your clients, that arise from customer data, from your breach of section 10 or 12, or from your integrations.

From us. We will cover your losses and reasonable costs from a claim that your permitted use of the service infringes someone's intellectual property rights, unless it is caused by customer data, your changes, combining tuix with things we did not provide, or use that breaks these terms. We may then change the service, get you the right to keep using it, or end the agreement and refund the unused part of your prepaid period.

The protected party must tell the other promptly, let it control the defence and settlement, and help reasonably. Neither may settle in a way that admits fault for the other without its consent.

19. Ending the agreement

The agreement starts when it is concluded (section 5) and lasts until it ends under this section.

Cancelling. An owner can cancel a paid plan at any time on the billing page. It runs to the end of the paid period, then the workspace lapses (section 9). Cancelling deletes nothing.

Closing your workspace. To end the agreement and have your data deleted, an owner writes to support@tuix.app from their sign-in address. We confirm by email and close the workspace.

By us. We may end the agreement with 60 days' notice for any reason, refunding the unused part of your prepaid period; if you seriously break these terms and do not put it right within 14 days of our notice; at once, if you break section 10 in a way that harms tuix or others, or if the law requires; or after a long lapse (section 9).

By you. If we seriously break these terms and do not put it right within 14 days of your notice, you may end the agreement and get a refund of the unused part of your prepaid period.

After the end. Access ends and the widget stops. For 30 days, an owner can ask us for a copy of the customer data. We delete customer data from our live systems within 30 days, and backup copies are overwritten within a further 15 days, as the DPA describes. Fees already due stay due. Sections 11, 12 and 15 to 22 continue to apply.

Switching to another provider. You may move your data to another provider or to your own systems at any time, as the EU Data Act (Regulation (EU) 2023/2854, art. 23 to 26) provides.

  • An owner asks by writing to support@tuix.app. The notice period is at most 2 months; you may choose a shorter one, or none.
  • After the notice period, a transition period of up to 30 days follows. During it we keep the service running, help you reasonably, keep your data secure, and tell you of any known risk to the continuity of your service. If we cannot complete it within 30 days for technical reasons, we tell you within 14 working days of your request, with our reasons and an alternative transition period of at most 7 months. You may extend it once by a period you think fits.
  • What you can take: reports, comments, statuses, assignments and history; screenshots and attachments as their original files; console and network entries; browser details and custom context; the identities your app sent; and your workspace, project, people and capture settings. We deliver them as JSON files, in a structure we describe with the export, and the original image files. Excluded are our software, your signing keys and access tokens, which we never hand out for security reasons, and our internal logs and traces.
  • After the transition period, you have at least 30 more days to retrieve the data. Then we delete it in full, as section 13 of the DPA describes, and confirm by email.
  • We charge nothing for switching, for the export or for the transition period.
  • The agreement ends when the switching is complete, or at the end of the notice period if you only want your data deleted.

20. Changes to these terms

We may change these terms and will publish each new version on tuix.app with its effective date. If a change is to your disadvantage, we will email the owners at least 30 days before it takes effect. If you do not agree, you can end the agreement before then and get a refund of the unused part of your prepaid period. If you keep using tuix after that date, the new terms apply. Changes required by law, or that only benefit you, may take effect sooner.

21. Law, disputes and complaints

These terms are governed by Polish law, without the UN Convention on Contracts for the International Sale of Goods. We will first try to settle a dispute by talking. All disputes and claims arising from or relating to the agreement are subject to the exclusive jurisdiction of the Polish courts. If talking fails within 30 days, the dispute goes to the common court competent for Warsaw. For sole traders under section 4, the Polish court competent under the general rules may also hear it.

Complaints. You can complain about the service, including about a decision under section 10, by writing to support@tuix.app. Please give your workspace name and the email address you use with tuix, what happened and when, and what you would like us to do. We reply by email within 14 days of receiving the complaint. If we need more information, we ask for it within that time, and the 14 days then run from your answer.

22. General

  • Notices. We send notices to the owners' email addresses; you send them to support@tuix.app. Email counts as written notice.
  • Transfer. You may not transfer this agreement without our consent. We may transfer it to a company that takes over tuix, if we tell you first.
  • Events beyond control. Neither party is liable for failures caused by events beyond its reasonable control, such as a major outage of an internet or hosting provider. This does not excuse payment.
  • Language. These terms are written in English. If we provide a translation, the English version prevails.
  • Whole agreement. These terms, the DPA and your plan are the whole agreement on this subject. Your own purchasing terms do not apply.
  • Invalid parts. If a part of these terms is invalid, the rest stays in force, and the invalid part is replaced by a valid one closest to its purpose.
  • No waiver. Not enforcing a right now does not give it up.
